Terms of Service

Last updated: 21 October 2026

1. Agreement

These terms govern your use of DiveHive, a service operated by AppMinds.dev Inc., a company incorporated in the Philippines (SEC registration no. 2026070257796-63), with its registered address at Behind Aya's Swiss Bakery, Sto. Niño, Puerto Galera, Oriental Mindoro 5203, Philippines ("DiveHive", "we", "us"). By creating an account or using the service you agree to these terms. If you use DiveHive for a business, you agree on behalf of that business and confirm that you are authorised to do so. If you do not agree, please do not use the service.

<!-- D165 draft: lawyer review before Plus goes on sale -->

Two parts, two audiences. These terms have two clearly separated parts. Part A (section 4, "Divers") covers the free diver app and the optional paid DiveHive Plus subscription, which are for personal use by individuals, including consumers. Part B (section 5, "Dive shops, clubs and subscriptions") covers the paid subscriptions for businesses and organisations, such as dive shops, liveaboard operators and clubs, which are not offered to consumers. All other sections apply to both.

These terms are written in English. Where a translation exists, the English text prevails.

2. The service

DiveHive is a business suite for dive centers, shops and resorts (schedule, fleet, staff, documents, bookings, online payment tools, boards, and modules such as POS and retail, accommodation and growth tools as they are released) and a network app for divers (logbook, trips, certifications). Features that are described as planned or coming soon are not part of the service until they are released.

DiveHive is not a dive operator and does not take part in diving activities. Dive contracts are made between the diver and the dive shop.

Payments between divers and shops. Where a shop offers online payments, the diver pays the shop directly, into the shop's own merchant account, through a payment provider that the shop connects. DiveHive never holds these funds and takes 0% of shop payments. Refunds, cancellations and disputes about a booking are a matter between the diver and the shop. Receipts produced by DiveHive are non-official receipts for information. Shops remain responsible for issuing official invoices and receipts and for the tax rules of their own country.

3. Accounts

  • You must provide accurate information and keep your sign-in methods secure.
  • You are responsible for all activity under your account.
  • You must be at least 16 years old to open your own account. A parent or legal guardian can create and manage a junior profile for a diver under 16 (see section 4).
  • Each person may hold one personal account.
  • We may suspend or close an account that breaks these terms, is used for fraud or abuse, or puts the security of the service at risk.

4. Part A: Divers (free diver app and DiveHive Plus, consumer use)

The diver app is free and is meant for personal, non-business use. The core diving features stay free. If you use it as a consumer, the mandatory consumer rights of your country stay unchanged; nothing in these terms takes them away.

  • You decide what to share with shops and with other divers in your privacy settings.
  • Waivers and medical forms you sign are records of the dive shop you sign them for.
  • Divers under 18 can be booked, take courses and log dives with the consent and signature of a parent or legal guardian. A guardian creates and manages the junior profile of a diver under 16; a junior aged 13 to 15 may also have their own login if the guardian invites them. Divers under 13 never have their own login. Minors are excluded from social features with strangers.
  • Dive safety remains your responsibility and that of the dive operator.

<!-- D165 draft: lawyer review before Plus goes on sale -->

DiveHive Plus (optional paid subscription for divers). DiveHive Plus adds paid features for individual divers, such as larger photo storage, as described in the app when you subscribe. You never need it to use the free diver app.

  • Price. Plus costs USD 3.99 per month or USD 29 per year. The price is the same worldwide and includes tax: the amount shown at checkout is the amount you pay. Paddle, as Merchant of Record, works out and pays the VAT, GST or sales tax that applies in your country out of that price.
  • Where you buy. On the web, Plus is sold by Paddle.com, our reseller and Merchant of Record, and Paddle's buyer terms apply to the purchase. If you buy Plus in the iOS or Android app, the purchase is made through Apple or Google and follows their terms for billing, cancellation and refunds.
  • Renewal. Plus renews automatically for the same period (month or year) at the then-current price until you cancel.
  • Cancellation. You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for, and you keep Plus until then. Web subscriptions are cancelled in your account or through Paddle; store subscriptions are cancelled in your Apple or Google subscription settings.
  • Right of withdrawal. If you are a consumer in a country that gives you a right to withdraw from a distance contract (for example 14 days in the EU and the UK), you can withdraw from your Plus purchase within the period set by law without giving a reason, by writing to us at hello@appminds.dev or through Paddle. If you ask for Plus to start straight away, we ask you to confirm at checkout that you want this. Where the law allows, we may then deduct from a refund a proportionate amount for the time you have already used Plus. This does not take away or reduce any right you have by law. Refunds on web purchases are paid by Paddle to the payment method you used; see our Refunds page at divehive.app/refunds.
  • If Plus ends. If your subscription ends or you downgrade, your notes, maps and dive data are never affected. Photos above the free allowance (100 photos) stay viewable and can be downloaded for 12 months, but you cannot add new ones. You can export all your original photos in one download at any time. After the 12 months we may delete photos above the free allowance, and we warn you by e-mail or in the app 60, 30 and 7 days before.
  • Price changes. We announce a price change for Plus at least 30 days before it takes effect, by e-mail or in the app. You can cancel before it applies.

5. Part B: Dive shops, clubs and subscriptions (businesses and organisations only)

<!-- D165 draft: lawyer review before Plus goes on sale -->

Paid subscriptions under this part are offered to businesses and organisations, such as dive centers, shops, resorts, liveaboard operators, and dive clubs and associations. They are not offered to consumers. A consumer who wants a paid plan for personal use can choose DiveHive Plus in Part A.

  • Business or organisation use only. By opening a shop or club account or subscribing, the person subscribing confirms that they act for a business or an organisation (a dive center, shop, resort, liveaboard operator, dive club, association or similar) and not as a consumer. Because the subscription is made for that business or organisation and not for personal use, no consumer right of withdrawal applies to it. Refunds follow our Refunds and trial page, as described below.
  • A dive shop account is opened by an owner who confirms they are authorised to act for the business.
  • Plans and prices. Shops pay a subscription per location, billed monthly or yearly, at the prices on our pricing page. Listed prices exclude taxes: Paddle, as Merchant of Record, calculates the VAT, GST or sales tax that applies in your country and collects it at checkout on top of the listed price. Every further location costs 20% less. Optional modules can be added to any plan as they become available. The Liveaboard module is priced per liveaboard boat.
  • Clubs. A club or association can use DiveHive free of charge up to 100 members. Above 100 members, the club needs the paid Club plan, a flat monthly or yearly fee at the price on our pricing page; the net price excludes taxes in the same way as shop prices. The person subscribing for a club confirms that they are authorised to act for it.
  • Free trial. Every new shop gets a 30-day trial with all modules switched on. No card is needed to start. If you do not choose a plan, the trial ends and your shop becomes read-only; nothing is deleted.
  • Renewal. Subscriptions renew automatically for the same period (month or year) at the then-current price until you cancel. We tell you at least 30 days before a price change takes effect.
  • Cancellation and refunds. You can cancel at any time. Cancellation takes effect at the end of the period you have already paid for. Refunds follow our Refunds and trial page at divehive.app/refunds.
  • Paddle. Subscriptions are sold by Paddle.com, our reseller and Merchant of Record. Paddle processes the payment, collects and pays the applicable taxes, issues the invoice and handles refunds on our behalf. Paddle's buyer terms apply to your purchase. We do not store card data.
  • Shop payments from divers. The shop is the seller to its guests and is responsible for its prices, taxes, invoices, refunds and consumer rights. See section 2.
  • Shops are the controller of the diver data they collect and must follow the Data Processing Agreement and applicable law, including waiver and medical form requirements.
  • Deleting a shop schedules it for deletion after 30 days. Signed documents are kept until their retention period ends.

6. Content and community

  • You keep the rights to the content you contribute, such as dive sites, sightings, photos and edits. You give DiveHive a non-exclusive, worldwide, royalty-free licence to host, display and use that content to run and improve the service, including showing it to other users according to your privacy settings. The licence ends when you delete the content, except for copies that other users have already received or that we must keep by law.
  • You confirm that you have the right to contribute the content.
  • No unlawful, misleading, infringing or harmful content. We may remove content that breaks these terms.

7. Safety information

Weather, tide and storm information is provided as a convenience and may be wrong or late. It does not replace the judgement of the dive operator or the diver, and you use it at your own risk.

8. Availability and changes

We work to keep DiveHive available but do not promise uninterrupted service. We may carry out maintenance and may improve, change or retire features. If we make a change that materially reduces what a paid plan includes, we tell you at least 30 days in advance, and you may cancel and receive a pro rata refund of the unused prepaid period.

9. Liability

<!-- D165 draft: lawyer review before Plus goes on sale -->

  • Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
  • The service is provided "as is". To the extent the law allows, we do not give warranties other than those stated in these terms.
  • To the extent the law allows, we are not liable for indirect or consequential loss, lost profit or lost business, or for diving activities, accidents or contracts between divers and shops.
  • To the extent the law allows, our total liability to you for any claim is limited to the amount you paid for the service in the 12 months before the event, or USD 100 if you use the service free of charge. For a paying subscriber, including a DiveHive Plus subscriber, the amount paid is the amount actually paid for the subscription (after tax is taken out where the price included tax) in those 12 months.
  • A dive shop will indemnify us against third-party claims that arise from the shop's operations, its content, or its breach of law or of these terms.
  • If you use the free diver app or DiveHive Plus as a consumer, the limits in this section do not apply to the extent they would limit rights that the law of your country gives you and that cannot be waived, for example rights to a refund, to a service that matches its description, or to compensation. Those rights stay unchanged.

10. Termination

You can delete your account at any time (Settings, Delete account). We may suspend or end access for breach of these terms. When access ends, your right to use the service ends, scheduled deletion runs as described in the Privacy Policy, and you may export your data first. Provisions that by their nature should continue, such as liability, governing law and payment obligations that have already arisen, continue after termination.

11. Governing law and disputes

These terms are governed by the laws of the Philippines. The courts of Oriental Mindoro, Philippines, have exclusive jurisdiction, except that mandatory consumer protection rights in your country of residence stay unchanged. Before starting a claim, please write to us at support@divehive.app so that we can try to resolve the matter.

12. Changes to these terms

We may update these terms. For material changes we give notice by e-mail or in the app at least 30 days before they take effect. If you keep using DiveHive afterwards, you accept the updated terms.
